I am dedicated to ensuring your privacy and safeguarding your personal information.

I collect and store personal data of various types and in different formats, including but not limited to the following:

o  Contact details (email address, phone number, date of birth, GP details) collected through the information form (I send to you via email).

o  Any personal information provided by you in emails or other electronic messages e.g. by text.

o Electronic notes of your sessions

• This information is collected and stored with your permission (consent) for the purposes of fulfilling our therapeutic contract and to enable me to identify you to other concerned health professionals should I feel there is a risk of harm to yourself or others.

• On occasions I may need to share your personal data with other professionals. Onward referral to another service (e.g. GP or other professional) or reports sent to third parties (e.g. GP or other professional). However, if personal data is requested by a third party, they will need to provide signed consent from yourself before data is released.  

•  I keep contact details and personal details such as GP and date of birth for the duration of our work together and for one month afterwards. Any personal data provided in emails and relevant to future therapeutic work is transferred to electronic notes and the email is then deleted. Emails relating to timings of sessions are kept until the relevant date has passed. Session notes are kept for 7 years to satisfy legal requirements for pursuing complaints.

• All electronic data is securely stored in password protected locations. Any data passed through a third provider e.g. GoDaddy and nilay@nilaycounselling.co.uk (email) is subject to the same security and protection under the EU General Data Protection Regulation (GDPR).

• ·You have the right to access any personal data stored by me at any time. Please submit requests in writing to nilay@nilaycounselling.co.uk

• I do not audio or video record our sessions on any device, and I ask that you do not record any session either. It is not permitted to post any content on any technology or social media platform.

• You can address any concerns about how your data is stored and used to the Information Commissioner’s Office at https://ico.org.uk/

UK Data Protection Law and EU General Data Protection Regulations (GDPR)

Data Protection Law lays down wide-ranging rules, backed up by criminal sanctions, for the processing of information about identifiable, living individuals. It also gives individuals certain rights in relation to personal data held about them by others.  For the purpose of the Data Protection Act 1998 (the Act), I am the Data Controller for Nilay Herrod Counselling and Psychotherapy. As such, I am registered with the Information Commissioner’s Office (ICO).
